Federal Updates:

​Employee Retention Tax Credit Reinstatement Act
HR 6161, the bipartisan House Bill introduced in December 2021, would restore eligibility for the ERTC for the fourth quarter of 2021. This would potentially impact your nonprofit’s bottom line by providing a refundable tax credit. Learn more here.
Over 40 national charitable nonprofits have signed the ERTC coalition letter in support of the renewal of this legislation. It is now open for regional organizations to sign.

Bringing the issue to the Senate, S 3625​ was introduced, with bipartisan support, on February 10, 2022 to temporarily reinstate the ERTC for employers subject to closure due to COVID-19. More information will become available as this bill moves through the senate.

Happening Now in Idaho

The most important legislative items affecting nonprofits in Idaho:
  • S1272: Allows for the donation of liquor for benevolent, charitable, or public purposes to nonprofits (currently only wine and beer donations are allowed)​
    • Nonprofit impact: Expands opportunities for receiving donations of liquor for charitable purposes (e.g. auction baskets, etc.).
  • H0442: Prevents local governments (e.g. cities) from regulating rent, fees, or deposits for leases of private residential properties (Currently local governments are only prohibited from controlling rents). Passed House; Headed to Senate. 
    • Nonprofit impact: Nonprofits engaged in housing work often foot the bill for application fees and/or deposits. If cities cannot put caps on application or deposit fees, it is likely that nonprofits will be asked to step in to foot the bill for residents navigating the housing crisis.
  • H0450: Provides employers (including nonprofits) with unemployment insurance tax rate stability. Will result in estimated $64M in unemployment insurance savings for Idaho businesses over next two years. Passed House and Senate unanimously. 
    • Nonprofit impact: Nonprofits paying into unemployment insurance will realize savings via rate stability. 
  • H0518: Legislation is intended to streamline the process of worker’s compensation settlement for employers and employees.
    • Nonprofit impact: Could reduce time and energy put towards solving issues of worker’s compensation within a nonprofit organization or on behalf of an organization’s patrons​
  • ​H0540: Updates current law: Would continue to require law enforcement responding to domestic violence and sexual assault calls to provide written information to victims about the availability of victim services (including shelter), including the right to ask the prosecuting attorney to file a criminal complaint.​
    • Nonprofit impact: If your nonprofit provides services, shelter, or legal support to victims/survivors of sexual assault, please be sure to update local law enforcement with a list of available services. 
  • ​H0581: Implement the Employee Medical Information Protection Act, ensuring employees not be discriminated against in the workforce because of their vaccination status in regard to any emergency use authorized vaccine (COVID-19 or otherwise).​
    • Nonprofit impact: Could potentially penalize workplaces with mandates currently in place.​
  • H0582: Allows a nonprofit and its volunteers to construct single family residences without the need to subcontract licensed individuals. Creates an electrical, plumbing, and HVAC licensure exemption for these volunteer services. 
    • Nonprofit impact: May impact nonprofits engaged in single family/unit homebuilding. However, there are questions regarding maintaining quality that may need to be addressed.
Contact your Legislators
  • ​S1240: Bipartisan bill would allow homeowners or tenants to update a housing covenant (to remove outdated, racist language) in compliance with federal law under The Fair Housing Act; Passed Senate; Headed to House.
    • Nonprofit impact: Nonprofits engaged in fair housing and housing development work should continue to monitor.
  • S1241: Increased the maximum value of a home that qualifies for the property tax reduction program.​
    • Nonprofit impact: Expands eligibility for property tax reduction (Circuit Breaker) program, helping more low-income applicants remain in their homes, potentially impacting a key demographic (low-income and seniors) of nonprofit human service providers in Idaho.​
  • S1268: Allows for the issuance of no-cost, 4-year identification cards for persons who are experiencing homeless. ​
    • Nonprofit impact: For nonprofits serving those who are homeless, an ID card is often a barrier to job and housing attainment/placement.​
  • ​​S1287: Established rural nursing loan repayment program, which would pay educational loan debts for nurses practicing in designated rural health shortage areas.
    • Nonprofit impact: May affect nonprofit health care providers, potentially improving their ability to recruit and retain nurses in rural areas.
